Scope and purpose of this privacy policy
This privacy policy aims to give you information on how we collect and process your personal data through your use of our Sites, including any data you may provide through the Services as a (i) website user, (ii) job candidate, (iii) client, or (iv) supplier of the 24 Seven Group. This privacy policy has been designed with reference to Applicable Privacy Law.
The Sites are not intended for individuals under the age of 18 years of age (“children”) and we do not knowingly collect data relating to children. If you learn that data of children has been provided to us, please contact us so that we may delete the information.
It is important that you read this privacy policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you have a full understanding of how and why we are using your data. Changes to the privacy policy and your duty to inform us of changes
We keep our privacy policy under regular review. We reserve the right to amend this privacy policy from time to time consistent with Applicable Privacy Law, so we suggest you check back from time to time to stay informed of such changes. Any changes will be immediately incorporated into this privacy policy and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so. We will not collect new types of personal data beyond what is disclosed in this privacy policy without providing you notice prior to the collection of that personal data. Your continued use of the Services after any changes are made to this privacy policy constitutes your acceptance of the changes. If any changes are unacceptable to you, you should cease all use of the Services.

Change of purpose

Our Sites may include links to third-party websites, plug-ins, and applications (including social media services) (“third-party sites”). Clicking on those links or enabling those connections may allow such third-party sites to collect or share data about you. We do not control these third-party sites and are not responsible for their privacy statements or privacy practices, including their level of data sharing with other third parties. Additionally, we are not responsible for the data processing practices of the internet browser service provider you choose to use when accessing one of our Sites. Your Legal Rights and Choices
Depending on the Applicable Privacy Law where you reside, you may submit requests based on a number of privacy rights that may be available to you and which are further described below. If you wish to exercise any of the rights set out below, please contact us.
Access.
You could have the right to request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
Correction.
You could have the right to request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
Deletion.
You could have the right to request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no legitimate reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data in certain instances, such as where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
Objection. (For EU/UK residents only)
You have the right to object to the processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms (although we will always remove your details from any marketing database if you ask us to do so).

You have the right to request restriction of certain processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

You could have the right to request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Withdraw Consent.
You have the right to withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain Services to you. Complain/Appeal.
You may have the right to complain or appeal to us if we reject your request or you believe we have violated your privacy rights. Also, depending on where you reside, you may have the right to submit a complaint with your respective data protection authority and/or state Attorney General.

How to Submit a Privacy Request
No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
Steps to submit a privacy request
If you would like to exercise any of the rights described in the “Your Legal Rights and Choices” section above (“privacy request”), please contact us. We will not discriminate against you for exercising your rights under Applicable Privacy Law. Further details on the steps needed to complete a privacy request are detailed below.
Step 1: Verifying the privacy request
Before we can fulfil your privacy request, we need to: (i) verify your identity or authority to make the request and (ii) confirm the personal data you are requesting belongs in fact to you. If you have a password-protected account with us, we may use our existing authentication procedures to verify your identity, however, you are not required to have an account with us to make a privacy request. For most other privacy requests, we will ask you to provide information that matches at least two pieces of personal data we store about you before responding to your privacy request. If you would like to request specific pieces of personal data that we have collected, or if you would like us to access or delete highly sensitive personal data, you must match at least three pieces of information we store about you, and you may be required to provide a signed declaration under penalty of perjury that you are the consumer whose personal data you are requesting. We may refuse any privacy request made regarding collected personal data if we are unable to verify your identity or if we cannot authenticate the legitimacy of your privacy request using commercially reasonable efforts. Under such circumstances, we may follow up with you for additional information as reasonably necessary to authenticate your privacy request. We will only use personal data provided in a verifiable consumer privacy request to verify your identity or authority to make the privacy request or if use of your personal data is required to comply with applicable law.
Authorized agents
You may grant an authorized agent written permission to submit privacy requests, but we may deny authorized agent privacy requests if we are unable to verify your identity directly as the subject of the personal data at issue. To verify a privacy request from an authorized agent, we may require proof that you gave the authorized agent signed permission to submit the privacy request, such as by requiring you to directly confirm with us that you provided permission for the authorized agent to submit the privacy request, and/or we may ask you to verify your identity directly with us.
Step 2: Responding to a privacy request
After verifying your identity, we will respond to your privacy request by either fulfilling the request or explaining why we are denying the privacy request. The timeframe in which we respond will vary based on the Applicable Privacy Law where you reside. If we deny your privacy request, you may have the option under Applicable Privacy Law to appeal this decision by contacting us. If you are concerned with the result of your appeal, you may have the right to contact your State Attorney General or applicable data protection authority.
Deletion requests
Please note that for deletion requests, any removal of content by us does not ensure or guarantee complete or comprehensive removal in all places. The content may have been shared or reposted by other parties who act outside of any business relationship with us or may not cooperate with our request for them to delete your personal data, or federal or state law may require maintenance of the content or information. We will do our best to accommodate your deletion request, but we cannot guarantee we can remove all personal data from its specified uses. Therefore, please be as specific as possible in the privacy request. If the privacy request relates to information that we need to make the Services function properly, you may not be able to use the Services properly moving forward. We reserve the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your personal data.
How to opt-out
As discussed in the “Your Legal Rights and Choices” section above, you may have the right to opt out of certain uses or disclosures of your personal data. Please review our Cookie Policy and the applicable privacy notice that pertains to you to learn more about how to exercise your opt out rights.
Automated Decision Making
You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making unless we have a lawful basis for doing so and we have notified you.
Save for website users (please see below), we do not envisage that any decisions will be taken about you using automated means.
Data Retention
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements. Data retention timeframe may vary based on your relationship with us. In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.
We may share your personal data within the 24 Seven Group, which may involve sharing your personal data with entities located outside of the country where you reside. In particular, we will store your details in our secure data storage centre located in the USA.
Whenever we transfer your personal data out of the country where you reside, we will comply with our cross-border data safeguard obligations under Applicable Privacy Law by ensuring at least one of the following safeguards is implemented:
Data security
We have put in place security measures intended to protect personal data from being accidentally lost, used, accessed in an unauthorised way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.

Consistent with our privacy policy, information obtained will not be shared with third parties/affiliates for marketing/promotional purposes. Frequency varies for text messages. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. You can reply STOP to cancel and HELP for help.

It is in our legitimate interests to decide whether to assign you to our assignments or put you forward for permanent positions with our clients since it would be beneficial to our business to appoint someone to that assignment/role with our clients. We also need to process your personal data to decide whether to enter into a contract with you. Having received your CV and the results from any tests or interviews with us or our client, we will then process that information for the purpose of considering your suitability for an assignment. If you are offered an assignment, we will then carry out any further steps necessary, such as take up references, carry out a criminal record check or any other background checks required by our client for the assignment.
If you are unsuccessful in securing a particular assignment or role (or decide not to take it up), we will retain your personal data for consideration for other assignments or roles unless you tell us otherwise.

Other than consent, the most commonly used lawful bases for processing are the following:
“Legitimate Interest” means the interest of our business in conducting and managing our business to enable us to give you the best Services and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). “Performance of Contract” means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
“Comply with a legal obligation” means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.
PERSONAL DATA
“Aggregated Data” typically means data that have been combined or collected together in summary or other form such that the data cannot be identified with any individual. Aggregated data could be derived from your personal data but is not considered personal data under Applicable Privacy Law.
“Personal Data” or “Personal Information” generally means information that can directly or indirectly be used to identify an individual or in some cases, an individual’s household. Personal data does not include data that is anonymized / de-identified or, under Applicable Privacy Law, data that is publicly available.
“Sensitive Personal Data”or “Special Categories of Personal Data” may vary under Applicable Privacy Law but the terms typically mean information pertaining to an individual’s race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, and/or health, genetic, and/or biometric data.
